# Privacy Policy

## 1. Who we are and what this policy covers

LifeSummary AI LLC ("LifeSummary," "we," "us," or "our") is a Delaware limited liability company headquartered in Scottsdale, Arizona. We build PersonaGraph, a data intelligence platform that helps benefits brokers, HR teams, benefits administration platforms, and healthcare navigation organizations structure their data and run AI agents on top of it.

This Privacy Policy explains how we collect, use, and share personal information in two situations:

- **When you interact with us directly**, for example by visiting lifesummary.ai (the "Site"), contacting us, requesting a demo, attending a meeting or event, or corresponding with us as a prospective customer, partner, investor, or vendor. For this information, LifeSummary decides how it is used and is responsible for it.
- **When we process data on behalf of our business customers** through the PersonaGraph platform. Section 8 explains how that works and why a different set of rules applies.

This policy does not apply to third-party websites or services that link to or from the Site.

## 2. Information we collect directly

**Information you give us.** When you fill out a contact or demo form, email us, schedule a meeting, or otherwise reach out, we collect what you choose to provide. This typically includes your name, work email address, phone number, company name, job title, and the content of your message.

**Please do not send health information through the Site.** Our contact forms and general email addresses are not designed to receive protected health information, benefits enrollment records, Social Security numbers, or similar sensitive data. If you need to share data of that kind, we will arrange a secure transfer under an appropriate written agreement.

**Information collected automatically.** When you visit the Site, our servers and service providers automatically receive certain technical information, including your IP address, browser type, device type, operating system, referring page, pages viewed, and the date and time of your visit.

**Cookies and similar technologies.** The Site uses cookies and similar technologies that are necessary for the Site to function and to keep it secure, and for the website analytics described below. We do not use cookies to target advertising to you. You can block or delete cookies through your browser settings, although some parts of the Site may not work properly as a result.

**Website analytics (Microsoft Clarity).** We use Microsoft Clarity on the Site to understand how visitors use it and to improve it. Clarity captures how you interact with the Site, such as the pages you view, clicks, scrolling, and mouse movements, and shows it to us as behavioral metrics, heatmaps, and session replays. Microsoft collects this information directly from your browser using first- and third-party cookies and similar technologies, and assigns each visitor a unique identifier. Microsoft uses the information it collects as an independent controller, including to provide Microsoft Advertising and for the other purposes described in the [Microsoft Privacy Statement](https://privacy.microsoft.com/en-us/privacystatement). We use Clarity only on the Site. We do not use it in the SMS Program or the PersonaGraph platform, and it does not receive Customer Data. You can limit this collection by blocking or deleting cookies in your browser settings.

**Information from other sources.** We may receive business contact information from event organizers, referral partners, or publicly available professional sources, such as a company website or professional networking profile.

## 3. How we use information we collect directly

We use this information to:

- Respond to your inquiries and requests, including demo and partnership requests
- Evaluate, negotiate, and manage business relationships with customers, partners, and vendors
- Send you information you have requested, and, where permitted by law, occasional updates about our products (you can opt out at any time)
- Operate, maintain, secure, and improve the Site
- Detect, investigate, and prevent fraud, abuse, and security incidents
- Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others

## 4. How we share information we collect directly

**Except for the website analytics information Microsoft collects through Clarity, described in Section 2, we do not sell personal information or share it for cross-context behavioral advertising.**

We share information only as follows:

- **Service providers** that perform services on our behalf, such as cloud hosting, email, and scheduling. They may use the information only to provide services to us.
- **Microsoft**, which collects information directly from visitors to the Site through Clarity and uses it as an independent controller, as described in Section 2.
- **Professional advisors** such as lawyers, accountants, and auditors, under duties of confidentiality.
- **Legal and safety reasons**, when we believe disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of LifeSummary, our customers, or others.
- **Business transfers**, in connection with a merger, financing, acquisition, reorganization, or sale of assets, subject to standard confidentiality protections. Any successor would be bound by commitments at least as protective as this policy for the information it receives.
- **With your consent** or at your direction.

## 5. How long we keep information

We keep information we collect directly for as long as needed for the purposes described above, including to maintain our business relationship with you, and as required to meet legal, tax, accounting, and audit obligations. Inquiry records that do not lead to a business relationship are generally deleted or de-identified within 12 months. Security logs are retained according to our security and audit requirements.

## 6. How we protect information

We maintain administrative, technical, and physical safeguards designed to protect personal information. These include encryption of data in transit and at rest, role-based access controls, logging and monitoring, and hosting in enterprise cloud infrastructure located in the United States. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

## 7. Your choices and rights

**Marketing emails.** You can unsubscribe from marketing emails at any time using the link in the email or by contacting us. We will still send transactional or relationship messages as needed.

**Access, correction, and deletion.** You may ask us to tell you what personal information we hold about you, correct it, or delete it. We will respond to reasonable requests regardless of where you live.

**State privacy rights.** Depending on where you live, including California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws, you may have additional rights, such as the right to know the categories and specific pieces of personal information we have collected, the right to data portability, the right to opt out of the sale or sharing of personal information or of targeted advertising, and the right not to be discriminated against for exercising your rights. Other than Microsoft's use of the website analytics information it collects through Clarity, described in Section 2, we do not sell or share personal information or engage in targeted advertising. Where required by applicable law, we treat recognized opt-out preference signals, such as Global Privacy Control, as a valid request to opt out.

**How to make a request.** Email us at [legal@lifesummary.ai](mailto:legal@lifesummary.ai). We will need to verify your identity before acting on certain requests, usually by confirming information we already have. You may use an authorized agent where permitted by law; we may ask for proof of the agent's authority. If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal," and we will respond within the time required by law.

## 8. Data we process for our business customers

Our customers, such as benefits brokers, employers, benefits administration platforms, and healthcare organizations, send data to PersonaGraph so we can structure it and power AI tools for their workflows. This data can include information about employees, plan members, and their dependents, such as enrollment elections, eligibility details, plan information, and related documents. We refer to this as "Customer Data."

**Our role.** For Customer Data, we act as a service provider or processor to our customer, and, where the data includes protected health information, as a business associate under the Health Insurance Portability and Accountability Act (HIPAA). We process Customer Data only to provide our services to that customer and as described in our written agreement with them, which may include a data processing agreement or a business associate agreement. That agreement, not this Privacy Policy, governs how Customer Data is handled.

**Our commitments for Customer Data.** Under our customer agreements:

- We do not sell Customer Data or use it for our own marketing.
- We do not use Customer Data to train or fine-tune general-purpose AI models, and we use AI model providers under terms that prohibit them from using Customer Data to train their models.
- Access to Customer Data is restricted by customer, and within a customer by role, so that users see only the data they are authorized to see.
- We use subprocessors, such as our cloud infrastructure and database providers, only under written agreements that require appropriate data protection.

**If you are an employee, plan member, or dependent.** If your information reached us through your employer, benefits broker, benefits administration platform, or health plan, that organization controls your information. Please direct requests to access, correct, or delete it to that organization. If you contact us directly, we will forward your request to the appropriate customer and assist them as our agreement requires.

## 9. AI features

PersonaGraph uses AI models to answer questions, compare plans, and surface insights from Customer Data. AI-generated outputs are provided to our customers and their authorized users as decision-support information. They are not medical, legal, tax, or benefits advice, and they do not replace official plan documents, which control in the event of any conflict. Our customers are responsible for how they present AI features to their own users.

## 10. Children's privacy

The Site is intended for business audiences and is not directed to children under 16. We do not knowingly collect personal information directly from children through the Site. If you believe a child has provided us personal information through the Site, contact us and we will delete it. Dependent information, including information about minors, that a customer provides as Customer Data is handled under Section 8.

## 11. International visitors

We are based in the United States, and the Site and our services are intended for U.S. businesses. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

## 12. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date above and, if the changes are material, we will provide additional notice, such as a notice on the Site or on our public change log at lifesummary.ai/changelog. Changes that affect Customer Data will be made consistent with our customer agreements.

## 13. SMS / Text Messaging Program

If you enroll in LifeSummary SMS Support (the "SMS Program"), we collect your mobile phone number, a record of your opt-in consent (including the date, time, and keyword used to enroll), and the content of the text messages you send to and receive from the SMS Program.

We use this information only to operate the SMS Program, which includes responding to your questions, sending program-related messages, processing HELP and STOP requests, maintaining records of your consent, and securing and troubleshooting the service.

**No sharing of mobile information.** We do not sell, rent, or share your mobile phone number or SMS opt-in consent information with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We may disclose this information only to service providers, such as our SMS delivery provider and cloud hosting provider, that process it on our behalf solely to deliver the SMS Program, or where required by law.

**Message frequency and rates.** Message frequency varies based on your use of the SMS Program. Message and data rates may apply.

**Opting out.** You can cancel at any time by replying STOP to any message. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent unless you enroll again. For help, reply HELP or email [legal@lifesummary.ai](mailto:legal@lifesummary.ai).

**Retention.** We retain SMS Program records, including consent records, for as long as needed to operate the SMS Program and to meet our legal and compliance obligations, after which they are deleted or de-identified.
